WHY INVEST IN CEARÁ

The location of Ceará is strategic for companies that wish to establish favorably closer to the main world markets. Ceará is only 6:30 hours away from Europe and from the United States by plane and is a safe destination with no political, ethnical and/or religious conflicts and also free from natural catastrophes.

The coastline of Ceará has outstanding aspects such as a regular coastline broken only by timid capes, small and calm inlets and estuaries of rivers. The dunes are spread everywhere and they frame the coast, alternated by high lands or rocks forming sea cliffs.

Establishing a Company

A company is considered to be a national one when, according to Brazilian laws, its headquarters and administration is in the country, respecting the Brazilian laws that determined the conditions of its existence, creation, functioning and dissolution and its recognition as a corporate entity.

The origin of the capital or the country where the partners live don't influence when determining if a company is Brazilian.

On the other hand, a company is considered to be Brazilian if constituted by Brazilians outside the country, but with a filed contract in Brazil, being enrolled and managed by Brazilians.

The same for those created abroad but established in Brazil, being it a business corporation or a private limited company, which have the authorization to work in Brazil and have transferred their headquarters to the Brazilian territory, having Brazilian citizens as directors.

The Brazilian law reckons the existence of many kinds of companies: General Partnership, Limited Partnership, Secret Partnerships, Limited Partnership with Stocks, Joint Stock Corporations and Limited Liability Companies.

Commercial activities can also be carried out under an Individual Proprietorship.

In spite of all these kinds of companies, only two are widely used in Brazil: Joint Stock Corporations and Limited Liability Companies.

This phenomenon is due to the possibility to limit the responsibility of each partner in the company and regarding third parties, which is not possible in the other kinds.

Evironmental Licensing

A result of the National Environmental Policy, the Environmental Licensing is how the qualified agencies analyze the environmental conditions of the location, facilities, extensions and operation of the activities or ventures using natural resources, aiming at controlling, conserving, improving and recovering, so as to promote social and economical development according to sustainable environment principles.

Licensing is constituted of a series of administrative actions leading to a conclusive result, which is the "Environmental License".

Are subject to it, all activities that use environmental resources and may cause real or potential pollution or degradation of the environment, developed by individuals or companies, including agencies in federal, state and city administration.

Visa Issuance

In Brazil there are seven kinds of visas: transit, tourist, temporary, permanent, courtesy, official and diplomatic.

The visas granted to foreigners to work in Brazil are the temporary and permanent stay.

Visas will be granted abroad by diplomatic missions, consular departments, vice-consulates and, when authorized, by the External Relations State Secretariat and by honorary consulates.

Renewal shall be granted in the same category in which the foreigner is classified, considering the estimated limits.

The foreigner condition in Brazil is defined by the Foreigner's Statute, Law number 6.815/80 and its changes, regulated by Act 86.715/81.

The period of stay in Brazil for the temporary visa for a business trip is 90 days.

Foreign Capital

Regarding the initial investment register, the procedures to be followed are quite simple.

However, as to the capital reinvested in the country, rules get a little more complex, but don't amount to great costs or extraordinary efforts for the investor.

There are no restrictions as to the amount of profit that may be sent abroad.

The prohibition rules that defined excessive taxation of profits to be sent abroad were repealed and replaced by more flexible ones.

In fact, the rules for remittances and repatriation of capital were considerably simplified as of 1991.

The Brazilian concept of foreign capital comprises all kinds of economic benefits, including money, property, services and intangible assets.

In practice, money investment is the simplest and most usual way.

According to the Brazilian Law for Foreign Capital, foreign capital is considered to be assets, machines and equipments that entered the country without initial expenses, meant for production of goods or services , as well as financial pecuniary resources brought to Brazil intended for economic activities, provided that they belong to individuals living abroad or corporations with headquarters abroad.
